These Terms of Service define the rules for using the Moj Fachowiec online platform, available at mojfachowiec.pl (hereinafter: "Service" or "Platform").
The owner and operator of the Service is Moj Fachowiec Limited, registered at 5 Brayford Square, London, E1 0SG, United Kingdom, under registration number 16955113 (hereinafter: "Operator").
The Service enables Clients to post jobs for professional services and Contractors to submit offers for their execution.
Using the Service constitutes acceptance of these Terms of Service and the Privacy Policy.
The Operator reserves the right to modify the Terms. Changes take effect 14 days from publication in the Service.
User – any person using the Service.
Client – a User registered as a person seeking professional services.
Contractor – a User registered as a service provider with appropriate qualifications.
Job – an announcement created by a Client describing the need for professional service.
STANDARD Job – a standard job for which Contractors can submit offers in the normal process.
EXPRESS Job – an urgent/emergency job requiring immediate contractor intervention.
Offer – a proposal to complete a job submitted by a Contractor.
Shortlist – a list of Contractors selected by the Client who receive contact details.
PRO Status – verified Contractor status enabling use of EXPRESS features.
Registration in the Service is free and requires providing accurate personal data and an active email address.
During registration, the User selects a role: Client or Contractor.
Contractors are required to provide accurate information about their qualifications, experience, and scope of services offered.
Users are responsible for maintaining the confidentiality of their account login credentials.
It is prohibited to share accounts with third parties or have more than one account.
The Operator reserves the right to verify Contractor data and suspend or delete accounts that violate the Terms.

Clients do not pay fees for using the Service. All features for Clients are free.

Contractors bear full responsibility for the quality and timeliness of services performed.
A STANDARD job is the default mode for posting jobs.
Process flow:
STANDARD jobs cover all service categories available in the Service.
Client can cancel a job before adding Contractors to the Shortlist without any consequences.
EXPRESS jobs are emergency services intended for situations requiring immediate contractor intervention.

Contractor agrees to contact the Client within 15 minutes of accepting an EXPRESS job. Failure to meet this deadline may result in reduced EXPRESS job visibility and PRO status downgrade.

The Service does not mediate in price setting or financial settlements between Contractor and Client. EXPRESS service rates may include urgency and immediate contractor availability fees. Service price may be set in advance or individually agreed with Client upon arrival.

Using the Service by Clients is completely free. Creating jobs, viewing offers, and adding to Shortlists involves no fees.

Contractor receives access to Client contact details (phone, email) only after paying the appropriate fee. Before payment, only basic job information is visible.

Payments are processed through Stripe. Contractor receives a payment link after being added to Shortlist or accepting EXPRESS job.

If Client cancels a job after Contractor has made payment, the fee will be refunded to the Contractor's account.
The Moj Fachowiec Service serves solely as a platform enabling contact between Clients and Contractors.
The Operator is not a party to agreements concluded between Client and Contractor.
The Operator is not responsible for:
Contractor bears full responsibility for executing jobs in accordance with law, industry standards, and safety rules.
The Operator makes efforts to ensure uninterrupted Service operation but does not guarantee continuous availability.
After completing a job, Client may leave a review about the Contractor.
Reviews should be honest, truthful, and relate only to the completed service.
It is prohibited to publish reviews that:
The Operator reserves the right to moderate and remove reviews that violate the Terms.
Contractor may report a review for verification if they consider it unjustified or untrue.
Users have the right to file complaints regarding Service operation.

The Operator processes complaints within 14 business days from receiving the report.
Complaint response will be sent to the User's email address.
Complaints regarding quality of services performed by Contractors should be directed directly to the Contractor.
The data controller of Users' personal data is the Operator.
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).

These Terms of Service take effect upon publication in the Service.
Matters not regulated by the Terms are governed by Polish law.
Any disputes arising from Service use will be resolved by competent courts.
The Operator reserves the right to temporarily suspend Service operation for maintenance purposes.
Using EXPRESS service constitutes acceptance of EXPRESS terms contained in §7 of these Terms.
